Centre issues Criminal Notice against West Bengal Former Chief Secretary Alpan Bandopadhyay under Section 51 of Disaster Management Act, 2005 in which there are provisions for Punishment of 1-year Jail and/or Fine, whoever violating Section 51 of Disaster Management Act.
Before going into the reason let's discuss first what is Section 51 of the Disaster Management Act, 2005.
Section 51: Whoever without the reasonable reason obstructs any officer or employee of the union or state government or a person authorized by National, State, District Authority in the discharge of his functions under this Act; or refuse to obey the guidelines of union or state government or a person authorized by National, State, District Executive Authority, Shall be convicted with a punishment which may extend to one year or with fine or with both, and also if such disobedience or refusal leads to the danger of the life of someone or imminent danger can be punished with imprisonment extending up to 2 years.
From this explanation, we can come to the conclusion that it is not a strict law because maximum to maximum it can only punish a person, who is violating Section 51, with 2-year imprisonment and fine.
Now, we will talk about the ignition point of this matter, which is crucial for any subjective case. Alpan Bandopadhyay is a 1987 batch IAS officer of the West Bengal cadre. On 24th May 2021, Mamta Banerjee demanded a three months extension for Alpan Bandopadhyay Service for managing the Covid-19 situation and after this, the Appointments Committee of the Cabinet (ACC) agreed and granted the extension. In this scenario cyclone, Yaas came into the picture, and PM was in Bengal to survey the damage caused by the cyclone. Prime Minister holds a meeting to share and discuss reports on Destruction caused by cyclone Yaas and invited CM Mamta Banerjee and Alpan Bandopadhyay. Alpan Bandopadhyay skipped that meeting which is unjustified behaviour shown by Civil Servant and on the same day Centre directed Alpan Bandyopadhyay to report to New Delhi.
On this, Mamta refused to released Civil Servant Alpan Bandopadhyay and wrote a letter to PM Modi and challenged PM that PM orders will not implement in West Bengal. And the same thing happened. Alpan Bandopadhyay refused to obey Central Government which is highly offensive and irresponsible behaviour of Civil Servant.
After consulting with CM Mamta Banerjee and State Government Lawyers, to protect himself from the Central government, he requested retirement from Mamta Banerjee and accepted. Mamta Banerjee after this created the post for Alpan Bandopadhyay as a special advisor for CM with three-year tenure.
This inappropriate behaviour of Alpan Bandopadhyay gives a way for new debate "Civil Servants playing in the laps of Motivated Politicians" This will harm the country in various ways. We do not know whether these types of Civil Servants were involved in settling Rohingyaas. Or they were the ones in managing violence in Bengal Maybe they are the ones who are providing cover to the illegal Bangladeshi migrants and providing them Voter Card and Rashan Card from Taxpayer's money. This is ridiculous. And due to his inappropriate behaviour Centre issues criminal notice against West Bengal Former Chief Secretary Alpan Bandopadhyay. I can truly say that he is the most corrupted Civil Servant playing in the laps of Mamta Banerjee
And I requested the government of India should transfer this case for CBI enquiry for better results
